1.0 Site description

Monkeys Fist Limited (Monkey's Fist) provides an advertising service via the Monkey’s Fist Yachting web-site to the yachting community, listing advertisements for yachts for sale, wanted to buy, and for lease, and provides other information related to the sport of yachting through links to clubs, class associations, weather, and other related sites.

2.0 Acceptance of Terms and Conditions

The term ‘site’ as used in these rules, terms and conditions, refers to the Monkey’s Fist Yachting web site ‘www.monkeysfist.co.nz’. By accessing the Monkey’s Fist Yachting site, the advertiser or user acknowledges that he/she is bound by the Rules, Terms, and Conditions detailed herein.

3.0 Amendment of Terms and Conditions

Monkey’s Fist reserves the right to make amendments to these rules, terms and conditions from time to time.

4.0 Advertising

Each advertisement submitted for publication on the site will contain one item only.

Prior to the expiry of the first ninety-day period, the advertiser may be contacted by Monkey’s Fist Yachting informing the advertiser that the advertisement will be expiring and requesting the advertiser to contact Monkey’s Fist Yachting if the advertiser wishes the advertisement to be published for an additional ninety-day period. No additional fees or costs will be incurred for any additional ninety-day period relating to the original advertisement submitted. Thereafter any further renewals will be at the sole discretion of Monkey's Fist.

5.0 Amendment / removal of content

5.2 The advertiser or user of the site agrees to ensure that all material posted to the Monkey’s Fist Yachting site is free from any objectionable, abusive, defamatory, destructive, obscene, criminal or unlawful information.

5.3 Monkey’s Fist reserves the right to remove or refuse to publish any material that has been posted to the Monkeys Fist Yachting web site that Monkey’s Fist, in its sole discretion, deems to be in breach of any of these terms and conditions.

5.4 If Monkey's Fist removes any advertisement or other material from the site, or refuses to publish any advertisement or information for a breach of these terms or conditions Monkey's Fist shall have no liability whatsoever to the advertiser.

5.5 Monkey’s Fist reserves the right to block any user from access to the site if in the opinion of Monkey’s Fist, the user or advertiser has breached any of these rules, terms, and conditions.

6.0 Ownership of content

All advertising information, including photos, submitted for publication on the site will become the property of Monkey’s Fist and may not be reproduced for use in other publications, websites, or other medium without the written consent of Monkey’s Fist.

7.0 Reliability and Accuracy of site content.

7.1 Monkey’s Fist makes no warranty relating to the accuracy of any information published on the site.

7.2 The user or advertiser acknowledges sole responsibility for the accuracy and reliability of any information submitted to the site for publication.

7.3 The user or advertiser acknowledge that they use the site at their sole risk and Monkey’s Fist (including directors and share holders) will be not held liable for any costs, damages, losses, or other expenses incurred arising from any information posted on the site, supplied by a user or advertiser, or errors relating to the publication of information on the site.

7.4 The user or advertiser accepts that any transactions conducted between other users or advertisers are done so entirely at the user or advertisers sole risk.

7.5 The user or advertiser agrees that Monkey's Fist takes no responsibility or liability for any information or advertisement supplied to the site and gives no warranties relating to items advertised or sold, or information posted on the site in respect of;

(a) ownership of any item;

(b) accuracy or truthfulness of any representation made;

(c) the quality, standard, description, seaworthiness, legality, or value of any item

(d) the ability of any item bought, or information gained, from the site to meet a users expectations or requirements.

7.6 All users and advertisers of the site acknowledge that:

(a) any financial transaction entered into as a result of any advertisement or information published on the site is at the sole risk of the advertisers and users of the site;

(b) Monkey's Fist accepts no responsibility for the satisfactory completion of any financial transaction made arising from advertisements or information posted on the site;

(c) Monkey's Fist shall have no liability for any costs, expenses, or loses incurred as a result of any financial transaction or agreement between users of the site.

Monkey’s Fist:

(a) is not responsible for any information or content available on other web-sites, accessed through links on the Monkey’s Fist Yachting site.

(b) makes no endorsement of any information or content published on other web-sites which have been accessed through links on the Monkey’s Fist Yachting site; and

(c) will not be held liable for any losses, damages or costs incurred from the use of any information or content from any other web-sites accessed through links on the Monkey’s Fist Yachting site.

8.0 Modification/Disruption of services

8.1 Monkey’s Fist reserves the right to amend, modify or remove the services of the site for maintenance or other activities related to the running of the site and to make any modifications in terms of the functionality of the site, while endeavouring to ensure that service disruption is kept to the minimum necessary to make such modifications.

8.2 Monkey’s Fist will not be held liable for any costs, damages or other expenses incurred due to temporary disruption of services relating to the site. Where possible users will be informed about service disruptions on the Monkey’s Fist Yachting site.

9.0 Privacy
